We going to stand up and 3 pledge allegiance to the flag. 4 (Thereupon, the Pledge of Allegiance 5 was recited.) 6 MR. ELIJAH: I'd like to call for a 7 roll to make sure that we have a majority. 8 Trustee Sims? 9 MR. SIMS: Yes. 10 MR. ELIJAH: Let the record show 11 that he's present. Trustee Ramsey? 12 MR. RAMSEY: Present. 13 MR. ELIJAH: And let the record also 14 reflect that Trustee Jones is not with us this 15 evening. 16 MR. SIMS: The approval of the 17 minutes. 18 MR. RAMSEY: I'll make a motion that 19 the minutes be approved for the meeting held on 20 April the 1st. 21 MR. SIMS: I second it. 22 MR. ELIJAH: So the motion has been 23 properly moved and seconded for the approval of 24 the minutes from April the 1st. I'd like to call 25 for the vote. Mr. Sims? 3 1 MR. SIMS: Yes. 2 MR. ELIJAH: And, Mr. Ramsey? 3 MR. RAMSEY: Yes. 4 MR. ELIJAH: Let the record reflect 5 that the meeting minutes for April 1st were 6 approved. 7 MR. SIMS: Clerk's business, 8 communications, et cetera. 9 MR. ELIJAH: We have no new 10 business. 11 MR. SIMS: Okay. Old business? Any 12 old business? 13 MR. RAMSEY: I don't think so, 14 Brice. 15 MR. SIMS: Okay. New business? Any 16 new business? 17 MR. RAMSEY: For new business we 18 have a commendation for Albert Dennis. I think 19 somebody here is going to make that presentation. 20 MR. BRADLEY: Yes, Mr. Chairman, 21 thank you. We got a letter from Police Chief 22 William P. McManus dated April the 28th of this 23 year to Chief Roy Mann, Jefferson Township Fire 24 Department, and I'll read the letter. 25 At about 2235 hours on Friday, April 4 1 the 18th, 2003, a 64 year old male was driving 2 his Jeep northbound in the 2100 hundred block of 3 South Gettysburg Avenue when, for an unknown 4 reason, he drove over the street's grassy median. 5 His vehicle then hit a small tree and flipped 6 several times. The driver was ejected a short 7 time later. 8 Off-duty Jefferson Township Fire 9 Captain Albert Dennis drove up to the scene. 10 Captain Dennis found the driver facedown in the 11 median and not breathing. Captain Dennis turned 12 him over, administered first aid until the 13 arrival of a Dayton medic unit. 14 The driver was removed to Miami 15 Valley Hospital in critical condition. He had 16 two collapsed lungs and internal injuries. He 17 was admitted to the hospital's intensive care 18 unit. Dayton Police West Commander Lieutenant 19 John R. Bardun reported that this man would have 20 undoubtedly died but for Captain Dennis' quick 21 and professional action. 22 I wish to highly commend Jefferson 23 Township Fire Captain Albert Dennis for his 24 life-saving action on this accident scene. His 25 quick and professional aid response was in line 5 1 with the highest traditions of the fire 2 department. Sincerely, William P. McManus, Chief 3 of Police, Dayton Police Department. I would 4 like to have -- 5 MR. SIMS: I'd like to have him come 6 up and Chief McManus. Give him a big hand now. 7 MR. McMANUS: Captain Dennis, on 8 behalf of the trustees, the fire chief, myself 9 and my staff, we wish to present this token of 10 our appreciation because of what you did, and it 11 says Captain Albert Dennis for above and beyond 12 the call of duty, May 6th, 2003. 13 MR. SIMS: All right. You know as a 14 trustee, I like that. It's our own that's 15 helping someone. That means so much to us in 16 Jefferson Township. You know, a lot people think 17 because we are volunteers, that we don't do this 18 or do that, but we got some good volunteer 19 people. We got a lot of people doing a lot of 20 things in Jefferson Township, so I am very proud 21 of you. I see you all the time over here. 22 All right. Appointment to the fire 23 department of three paramedic/EMT. 24 UNIDENTIFIED SPEAKER: One 25 paramedic. 6 1 MR. SIMS: One? Appointment to 2 the -- okay, one. Okay. 3 UNIDENTIFIED SPEAKER: Paramedic 4 intermediate, not an EMT. 5 MR. SIMS: Yes. 6 MR. RAMSEY: I'll make a motion that 7 the appointments of Aundray Toney, Robert 8 Shepherd and Rachel Sever be accepted. 9 MR. SIMS: I second it. 10 MR. ELIJAH: It's been properly 11 moved and seconded. I'd like to call for the 12 roll. Trustee Sims? 13 MR. SIMS: Yes. 14 MR. ELIJAH: And, Trustee Ramsey? 15 MR. RAMSEY: Yes. 16 MR. ELIJAH: Please let the record 17 reflect the acceptance of the vote. 18 MR. SIMS: Trustees' report, Mr. 19 Ramsey? 20 MR. RAMSEY: We had a very 21 successful Unity Breakfast on April the 19th. We 22 are in the midst of putting Jefferson Township 23 Days together, and it looks like it's going to be 24 a pretty good affair. Anybody that wants to 25 volunteer, let us know, you can call this office 7 1 and they'll take your name and you'll receive a 2 letter. Other than that, Brice, I don't have 3 anything else to say. 4 MR. SIMS: I'd like to say that 5 you're doing a good job on Jefferson Township. 6 Do you all meet every Sunday right here? 7 MR. RAMSEY: Right. 8 MR. SIMS: And I think this is going 9 to be a good day for us because we are going 10 early. Usually when we go, usually Dayton has 11 something like on the holiday, but we going to go 12 early right now and I think it should be a very 13 successful community affair. 14 I'd like to say that the Unity 15 Breakfast was beautiful. We had a lot of people 16 there. It's getting larger every year, and we 17 need a lot of participation, you know, we -- we 18 just don't want just different people in 19 different areas, we want everybody in our 20 township to participate, and it's -- I mean, we 21 have a good breakfast and then we leave, we talk, 22 we communicate with the people there and it's 23 really a nice affair. 24 The other thing is I'm very 25 concerned about, with everybody else, Permafix. 8 1 Okay. We have done what we had to do as trustees 2 to try to block this. It's going into other 3 phases. We got good people that's working on 4 this, too, but I'm very concerned about it right 5 now. I don't know where it's going. You know, 6 I'm just like you in the paper, you know, picking 7 up things, but I'm very concerned, the trustees 8 are very concerned. So I want to let you know 9 that we are very concerned about the whole 10 situation. 11 Risk management activities for 12 April, Robert? 13 MR. BRADLEY: We repaired a stop 14 sign at Lawncrest and West Third Street on April 15 22nd, and that was the extent of the risk 16 management activities. 17 MR. SIMS: Okay. Approval of 18 financial report. 19 MR. RAMSEY: I'll make a motion that 20 the financial reports for April be accepted. 21 MR. SIMS: And I'll second it. 22 MR. ELIJAH: Please let the record 4 reflect the acceptance of the financial report. 5 MR. SIMS: Thank you. We got Mary 6 Johnson and Willa Bronson. 7 MS. BRONSON: Well, we would like to 8 acknowledge the leadership that has been provided 9 by Jefferson Township Trustees and the Jefferson 10 Township School District. We were the first body 11 of government to pass a resolution or announce a 12 position of statement against having VX 13 hydrolysate being transported and processed in 14 Jefferson Township, and because of this 15 leadership, then we have also had other passage 16 from Trotwood, City of Trotwood, on April 7th, 17 and I quote, accordingly, this council urges all 18 appropriate governmental entities to take 19 appropriate action to prevent the introduction of 20 VX or VX by-products into the area. 21 And it's been because of this 22 leadership provided, these other municipalities 23 have also supported this position along with New 24 Lebanon and along with the City of Dayton, and 25 just new, Harrison Township has signed on as of 10 1 yesterday, so we want to thank you. 2 MR. SIMS: I'd like to thank Mary 3 and Willa, they're our -- they're soldiers. You 4 know, I mean, you know, they get out here and 5 they work. I talked to -- I talked to Mary for 6 two hours on the phone, and I couldn't get her 7 off the phone. My wife wanted to say was that my 8 girlfriend, and I said no, she talking about 9 Permafix. Yeah. I'm serious about that. Okay. 10 John T. Cors. 11 MR. CORS: Yeah. John T. Cors, 5121 12 Germantown-Liberty Road. A little bit of 13 knowledge is dangerous. These flyers were back 14 here and I had read one, and it's presented in 15 the interest of good government by the Ohio 16 Township Association. It says township trustees 17 also have responsibility for ditches, drains and 18 other surface waters. Now, how do you interpret 19 that? 20 MR. SIMS: We have jurisdiction over 21 our ditches, which is our streets. All our 22 streets are -- some of them are county and others 23 is Jefferson Township. Now, I can -- after the 24 meeting, I can go over all the particulars with 25 you about our ditches, our streets, and then the 11 1 county has to do what they have to do with 2 their -- 3 MR. CORS: In particular, I'm 4 talking about roadside ditches which -- 5 MR. SIMS: That's what I'm talking 6 about. 7 MR. CORS: -- adequate or 8 inadequate. 9 MR. SIMS: Right, that's what I'm 10 talking about. 11 MR. CORS: And you said -- do you 12 consider you're responsible for those? 13 MR. SIMS: I'm responsible for 14 Jefferson Township roads. 15 MR. CORS: And the ditches along 16 those roads? 17 MR. SIMS: Yes, sir. 18 MR. CORS: There's a field next to 19 me which the water just dried up before these 20 most recent rains, so there's water in there 21 again, and it drains into a ditch, but the ditch 22 isn't adequate. 23 MR. SIMS: In other words, probably 24 the ditch is probably not cleaned out. That's 25 that tile you're talking about. 12 1 MR. CORS: Yeah. Well, it's not 2 a -- it -- the ditch to the tile is not deep 3 enough and it's overgrown and silted in in 4 places. Now, do you consider your -- the 5 township responsible to improve that ditch? 6 MR. SIMS: We are responsible for 7 cleaning ditches out, and what I will do is have 8 Mr. Bradley to get with Thompson on that. What's 9 the address there, John? 10 MR. CORS: Well, it's next to me. 11 It's not my ditch, so, but -- 12 MR. SIMS: Well, what's your 13 address? 14 MR. CORS: 5121 Germantown-Liberty. 15 MR. SIMS: 5121? You got that, 16 Robert? 17 MR. BRADLEY: Yeah. 18 MR. CORS: It's south of there. 19 MR. SIMS: Yeah. We'll look into 20 and get back with you. 21 MR. CORS: Okay. The other one, and 22 I think Marvin Gebhart showed you people, is the 23 jerry rig our road department did on the ditch 24 along Hemple Road. 25 MR. SIMS: Was that the narrow road 13 1 that we was talking about? 2 MR. CORS: Yeah, where they -- they 3 took some telephone poles and drove in some 4 fenceposts and put some recycled asphalt in there 5 to widen the road about a foot and they were 6 supposed to come back and fix it, but apparently 7 they didn't. Mr. Gebhart had talked about that 8 and I think he showed some of the trustees that 9 ditch. 10 MR. SIMS: Well, I saw it. 11 MR. CORS: You know. 12 MR. SIMS: Yeah. 13 MR. CORS: You know what I mean. 14 MR. SIMS: I know what you mean. 15 Robert, get with Thompson on that and make sure 16 we follow up. Some things we need to follow up 17 on because that's been quite a while. 18 MR. CORS: Yeah, it's been a couple 19 years. There was four accidents along there. 20 MR. SIMS: Yeah, I know because we 21 had one accident, that's why I came out there to 22 check it out because of the narrowness of the 23 road. 24 MR. CORS: Thank you. 25 MR. SIMS: All right. Michelle 14 1 Cooper? Unity Breakfast. 2 MS. COOPER: Michelle Cooper, 3324 3 McLin Drive. I would just like to know the 4 criteria that was used to select Steve Rauch as 5 the Jefferson Township businessman of the year. 6 THE WITNESS: I will let you know 7 that Steve Rauch give us -- some money to 8 Jefferson Township every year. He sponsors a 9 sponsorship, plus he bought a table and plus when 10 we have the bulk cleanup, he has his trucks in 11 the Drexel area, he does that free for us and use 12 his employees to get rid of the trash, so that's 13 why we did that. 14 MS. COOPER: And that made him the 15 businessman of the year with all the bad stuff 16 that he has tried to do? 17 MR. SIMS: I don't know the bad. 18 I'm just telling you about -- that was our 19 concern. 20 MS. COOPER: Thank you. 21 MR. SIMS: And then next year we'll 22 be having another businessman of the year and we 23 go through the same criteria who probably -- 24 whoever it is. That's the only thing that I was 25 concerned about. 15 1 MS. COOPER: I see. Thank you. 2 MR. SIMS: Is there any other thing? 3 MS. COOPER: No, I just wanted to 4 know the criteria that was used to select that 5 particular gentleman. 6 MR. SIMS: Yeah. Well, he's been 7 doing this for a while, a lot, Michelle. He does 8 this every year to help us out. Is there any -- 9 MS. BRONSON: Are you passing 10 citizen comments? 11 MR. SIMS: Well, yeah, I got -- 12 MS. BRONSON: I didn't -- I didn't 13 get my three minutes, but really it's necessary 14 for me to say that this room is filled with 15 people, and not just Mary and me, that there are 16 a lot of other people that are helping that are 17 collaborating with us, a lot of citizens that 18 are -- 19 MR. SIMS: I know there's a lot of 20 people, but I'm just saying specifically you come 21 up here and you talk to me all the time and you 22 talk to me on the telephone. That's why I 23 brought that up. 24 MS. BRONSON: Right. Well, we 25 appreciate that. 16 1 MR. SIMS: I don't want to exclude 2 nobody out, you know, because everybody's been 3 working very hard on this. 4 MS. BRONSON: And we appreciate the 5 recognition, but there are a bunch of people that 6 are making all the meetings and that are, you 7 know, doing a lot of hard work. 8 MR. SIMS: We understand all that. 9 We understand all of that. 10 MS. BRONSON: Thank you. 11 MR. RAMSEY: I'll make a motion that 12 the meeting be adjourned. 13 MR. SIMS: I second it. 14 MR.
